EZY-Go© is an online sales portal where multiple participants sell online package inventories to consumers and corporate businesses. EZY-Go is responsible for marketing, promotion and distribution. The participant is responsible for package execution and service the customer .
EZY-Go is an independent distribution channel for reliable quality partners interested to connect to buyer groups to sell complete packages. EZY-Go is an independent distribution channel of these packages. EZY-Go or B-Concept Media Entertainment Group Co., Ltd. select the participating partners carefully but can never be held liable for the execution of these packages. EZY-Go promotes these packages both online and offline.
EZY-Go follows the vision: "We deliver fun and happiness". We offer a high quality technology platform that markets, distributes and sells packages via the internet, through e-newsletters, social networking and traditional channels.
EZY-Go sells packages for activities, adventure, attractions, corporate, dining, entertainment, golf, holidays, leisure, MICE, spa, sport and weddings.
All the packages clearly display the package content, the price, package and price in- and exclusions and add on optional items provided within the package and with the opportunity to purchase. The package details upon the time of sales are executed by the participating partner. EZY-Go will distribute and follow up the package confirmation with the participating partner.
All the packages in EZY-Go are provided by multiple participants. Participants are professional companies providing products and services to EZY-Go. After signing the EZY-Go agreement, the participant has agreed and committed to take full service and execution responsibility of the package sold according the package content at the time of sales.
With the partner's grand diversity and various industry backgrounds the existing partner's sales and service conditions prevail above these terms and conditions. At the time of sales the package buyer agrees with the terms and conditions of both EZY-Go and the participating partner.
For any customized packages that includes adjusted sales, services and execution different conditions shall apply and will be added as appendix to the corporate agreement.
For clarity EZY-Go is an online distribution channel and not a travel agent or tour operator. EZY-Go only distributes, offers sales and payment opportunities to create buyer's purchasing conveniences.
The buyer confirms at the time of purchase to accept the order confirmation, terms and services, payment and accepts the Participating Partner, responsible for the package execution.

1. Introduction
1.1. EZY-Go sells, markets and distributes packages on behalf of participating companies to corporate delegates, groups and individuals via an online sales channel under the name EZY-Go.

1.2. The Reservation serves as a proof for the package reservation until the payment has been received by EZY-Go. Once online or offline payment has been made by the purchasing party and received by EZY-Go the reservation will be changed into an order confirmation binding the purchasing party with the participant.

1.3. The Buyer is the binding party who has confirmed the package service and has accepted that the Participating Partner provides the service to the Purchasing Party to the best of his ability. The Participant herewith agrees with the order confirmation to accept the package execution for the buyer.

1.4. EZY-Go is a distribution channel, connects both parties with the purpose to summarize package sales for multiple partners, build consumer convenience to purchase these packages, and increase online sales for participating partners through marketing and distribution. EZY-Go works for payment acceptance with independent partners and therefore cannot be held liable for these partner's failure of service provision.

1.5. Work days for EZY-Go support office are defined as Mondays to Fridays excluding government holidays.

1.6. Office hours between 09:00 AM and 18:00 PM Thailand time (GMT +6) are the hours that EZY-Go operates.

1.7. Online support requests can be sent to clientcare@ezy-go.com. Assistance is provided within 1-3 workdays.

2. Validity and exclusions
2.1. These terms and conditions are valid for all order confirmations and include all services provided. EZY-Go has the right to claim these terms and conditions for any package sold through EZY-Go. The Buyer agrees with the terms and conditions at the time of booking.

2.2. For incentive travel, events and groups other terms and conditions shall apply and will be separately signed for as appendix to the service agreement providing these services.

2.3. Each participating partner has the option to include partners in the package for which these partner's terms and conditions shall apply.

3. Pricing and Taxes
3.1. EZY-Go charges the package price to the buyer in Thai Baht. For any purchase outside Thailand following a different currency, the currency will be converted to Thai Baht following the currency exchange rate at purchase time.

3.2. EZY-Go prices are including 7% VAT. The order confirmation, invoices and payment receipts will specify the amount of VAT.

3.3. Credit cards accepted are Visa Card, Master Card, JCB and Visa Card and Master Card debit cards are supported for the transaction.

3.4. In the near future EZY-Go supports a cash channel that includes 7eleven, ATM machines and Tesco Lotus in Thailand and American Express Cards.

3.5. For corporate groups who require an official receipt tax invoice and withholding tax exchange form the withholding tax will be added to the sales price before VAT.

3.6. The buyer agrees not to deduct any costs from the payment obliged to pay to EZY-Go. If deduction of costs takes place, EZY-Go is entitled to on hold the package execution until full payment has been received.

4. Provisions
4.1. Non-commercial flights that include VIP Jets, Helicopter, Limousine and VIP Concierge Services apply for separate provisions. The Buyer can apply for a copy of these conditions at all times.

4.2. During the booking the Buyer can add online and purchase for a travel insurance. Terms and conditions of the insurer shall apply and prevail at all times. EZY-Go sells travel insurances for domestic, inbound and outbound.

5. Promotions and Offering
The Agreement is based on Participating Partner's offerings. The Agreement confirmation takes place through internet and email distribution or by invoice receipt. The Agreement becomes valid after receipt of payment on the EZY-Go bank account.

6. Price
6.1 The Participating Partner's offerings are free of any obligations. The Participating Partner is free to adjust or remove the offering from EZY-Go. If due to circumstances the Participating Partner decides to recall the booking, the Participant or EZY-Go on behalf but without liability shall recall the booking within 8 office hours with the reason of adjustment. Both the Buyer and the Participating Partner shall inform EZY-Go about the reason for recall of the booking. Errors in the travel price calculation is accepted, errors in increasing the package sales price is only accepted under clause 4.

6.2 Personal information

The Buyer agrees to provide at the time of booking correct honest information about himself and other people participating in the package which are important to confirm and execute the agreement properly and lists any details regarding the nature, formation or relationship of the listed package participants that may be important for proper package execution.

6.3 Shortage of information

If the provided information falls short that has a negative price impact the Participating Partner has the right to charge for the additional expenses occurred.

6.4 Personal Liability

The Buyer who on behalf of the other package participant enters into a booking and agreement with EZY-Go, indirect with the Participating Partner is personally liable for all the obligations under the agreement. The other package participants are personally liable for their information provision.

6.5. Publishing

If the agreed package is published with separate terms and conditions the published terms and conditions form part of the Agreement. If the Participating Partner publishes package conditions elsewhere who are in conflict with the package conditions on EZY-Go, the Participating Partner is obliged to solve the conflict within 7 days after the booking and inform both EZY-Go and the Buyer with the solution in writing. Obvious errors by the Participating Partner from the Buyer's perspective must or should be recognized.

6.6. On medical grounds alternatives, adjustments or additions to the package shall be required. The Participating Partner shall respond to the Buyer unless the package is not reasonably to demand from the Buyer. Essential medical needs the express written consent of the organizer as well a medical liability form for the Buyer to hand over to the Participating Partner. The execution of the Package is at final decision making with the Participating Partner. If the Participating Partner has decided to execute the package the Participating Partner has the right to charge additional costs to make package execution possible that includes costs for special organizing, communication and special execution expenses. The additional charges require the written consent of the Participating Partner and a written acceptance of the Buyer to pay these additional expenses.

6.7. With packages that includes transport will be written in the Package Description. If transport is optional this has to be additional purchased with the Package. If transport is not published, the Buyer is responsible for own transportation from and to the location where the Package is executed. If transport is included, the exact departure and arrival times will be shared with the Buyer. These times are final and the Participating Partner has limited rights to adjust these times. The Participating is not liable for any delays from airline, ferries, ground transport departure or arrival times.

6.8 Marketing

The Participating partner and EZY-Go are not responsible to share documents, media or any other files with the Buyer if published under the copyright from these parties.

7. Payment
7.1. With the reservation the Buyer agrees and acknowledges that the package only then is confirmed when payment from the Buyer has been received.

7.2. The Buyer agrees to confirm the reservation within 48 hours.

7.3. Cash payment or payment transfers to our bank account can occur delays of at least one work day. The payment shall be received within 24 hours after the reservation has been made and at least 5 days prior to the package execution.

7.4. For late or non-payments the Buyer is in payment default. Both the Participating Partner and EZY-Go have the right to cancel the booking within 3 days after acknowledgement to the Buyer by email. If payment has not received within 3 days, EZY-Go has the right to cancel the agreement immediately and making the Buyer liable to pay for the cancellation costs as written in the terms and conditions where the Participating Partner's terms and conditions prevail. The Participating Partner can never held EZY-Go liable for non-payment of the buyer.

7.5. For groups with minimum 25 package participants, different payment conditions may apply.

7.6. For all bookings 100% advance payment applies.

8. Package
8.1. The Amount published is per person unless it has been specified by the Participating Partner. The services as published are included in this amount.

8.2. The Amount published is based on the price, currency exchange, charges and taxes known by the Participating Partner at the time of publication.

8.3. The Participating Partner agrees to execute the package for the price published excluding under clause 4.2.written reasons if payment has not been received and keeps the right to adjust minimum 20 days prior to the execution date inclusive fuel costs rising, additional tax or other charges.

8.4. After payment has received the Participating Partner shall not adjust the confirmed amount and package content and services that have been confirmed at the time of sales.

8.5. If the Participating Partner will adjust the price after reservation has been made, but payment has not been received, The Buyer is entitled to reject the price change and must on forfeiture of his right inform EZY-Go within 3 business days. If the Buyer will use his right, The Participating Partner will cancel the Agreement immediately without charging any costs to the Buyer.

9. Execution
9.1. The Participating Partner shall immediately provide the Buyer, after the package has been confirmed and payment has been received, with general information about the package, execution of the program, arrival and departure times, legal, health and risk information and other formalities that is necessary for smooth package execution. Any changes in the above the Buyer shall be informed direct by the Participating Partner.

9.2. If the package cannot be executed due to missing information or valid documents, The Buyer is responsible for any result of outcome unless the Participating Partner has given the written obligation to provide this. In the last case the Participating Partner is liable for the result and a suitable solution shall be given to the Buyer within 7 days. However, the Participating Partner is liable for the height of amount the corporate liability insurance of the Participating Partner covers.

9.3 During departure, travel or package execution the Buyer is able to provide the necessary package documents added with a valid passport or if accepted ID Card and if required the visa, vaccines and vaccinations, domestic or international driving license, green card.

9.4. At time of booking EZY-Go offers the Buyer a travel insurance. The Buyer can purchase the travel insurance direct online at the time of reservation or can choose to purchase the travel insurance at a later stage or through a different channel.

10. Documents
10.1 The required travel documents shall be sent to the Buyer before the departure date unless this term must be exceeded due to justified reasons. If he Buyer hasn't received the documents 5 days prior to departure, the buyer shall inform EZY-Go or the participating partner. If the booking has been made 10 days prior to departure the Participating Partner shall inform how and when the Buyer shall receive these documents.

11. Adjustments and cancellation
11.1. The Buyer is entitled to add on services to the booking until 28 days prior to departure and if possible EZY-Go shall honour these requests. The Buyer is not entitled to reduce package services.

11.2. After payment receipt cancellations cannot be accepted unless for certified medical reasons. Under certified medical reasons, The Buyer is obliged to provide a written medical statement in which a certified medical specialist disapproves the package execution. In this case EZY-Go is entitled to charge cancellation expenses and deduct this amount without Buyer's approval and transfers the rest payment to the Buyer.

11.3. After payment receipt the Buyer is entitled to postpone the package execution to a later date within 48 hours after the booking has been made and if the Participating Partner agrees to make this postponement. For booking adjustment, the Buyer accepts a charge of 1,000 Thai Baht (app. 25,00 Euros/ 33,00 US$) to be charged to the Buyer's credit card or before the change has been made paid to EZY-Go bank account.

11.4. If a request has been made to EZY-Go a decision follows within 48 hours. If the request is disapproved the Buyer shall be informed with the reason for disapproval. The Buyer can continue with the original booking or cancel the booking. If the Buyer cancels the booking no refund will be made.

11.5. Packages based on own transportation can bo be adjusted unless the Participating Partner accepts to meet the Buyer's requirements.

11.6. The Buyer is entitled in-time to change the name of the package participants. With the replacement of the original package participant to a new package participant all the terms and conditions and liabilities are automatically accepted by this new package participant. With in-time is meant that both EZY-Go and the Participating Partner are able to execute the necessary formalities and processes to change the booking. The terms and conditions of the Participating Partners must not disapprove a change in a new package participant.

11.7. The new package participant or the buyer on his / her behalf are fully liable to the Participating Partner for any additional payments. These additional charges related to the change shall be charged additional to adjustment fees written in 7.3.

11.8. If an agreement is cancelled due to Act of God, national disaster, terrorism attacks, or any unforeseen circumstances the paid amount shall be refunded to the Buyer less administration costs and credit card expense charges. If the Cancellation is made by the Buyer and the Package consists of programs by different partners, the terms and conditions from these partners shall apply for the various parts within the package and cancellation amounts shall be confirmed by the Participating Partners involved.

11.9. The cancellation charges shall not exceed the package sum of amounts.

11.10 If the Buyer can prove with hard files and documents that the damage occurred by the Participating Partner is less than the amount to be paid for the cancellation, the Participating Partner is obliged to honour the Buyer's request to review the case and offer a suitable solution. The Participating Partner has the right to use the expertise of Law enforcements to defend the cancellation charges to the Buyer.

11.11 Any Cancellation made by the Buyer for an agreement what effects the minimum participant requirement, EZY-Go and the Participating Partner have the right to cancel all the agreement charging for the expenses as stated in the previous clauses.

11.12 In case that the booking has to be cancelled and a new booking must be made at a new confirmed price, the cancellation and adjustment expenses shall deducted or adjusted to the new confirmed price.

11.13 Cancellations will only be accepted during work days and office hours. If a cancellation is received outside office hours, the cancellation is expected to proceed on the next working day.

12. Cancellation by the Participating Partner
12.1. The Participating Partner has the right with immediate effect to adjust or cancel the agreement due to disasters, attacks, terrorism, commercial airline, accommodation, part of program by sub partners' cancellation.

12.2. For commercial airline, accommodation or part of the program cancellation, The Participating Partner shall do what is within his ability to provide equivalent replacement within time. If this is not possible, the Participating Partner will inform the Buyer with the reason for cancellation. In that case the Buyer has right on a full refund of the paid amount.

12.3. For a package where the group size is less than the minimum required.

12.4. If it is proven demonstrable that the Participating Partner adjustment causes damages to the Buyer, the Participating Partner shall provide a suitable financial compensation to the Buyer. The compensation shall never exceed the sales amount of the purchased package or the covered amount within the insurance. Damages that are not proven demonstrable is for the own party's account and none of the parties can be held liable.

12.5. If the Participating Partner decides to adjust the package program due to significant circumstances, this Party is obliged to inform the Buyer within 48 hours (2 workdays, weekends, official holidays excluded) and provide an adjusted equivalent proposal for an alternative program through EZY-Go. The Buyer has the right to adjust or cancel the program. The Participating Partner is not entitled to direct acquire with the Buyer unless EZY-Go has approved in writing.

12.6. Equivalent adjustments in the program and equivalent replacements shall objectively be measured based on:
  • Location where the accommodation is situated
  • Class of the accommodation
  • Facilities
  • Possible upgrades or price discounts
  • Formation of the package participants
  • Buyer's requirements shared at the time of the booking
  • Add-on to the package confirmed in the order confirmation to the Buyer
  • Personal circumstances significant for the Buyer
 
12.7. If the Buyer rejects the package adjustment or change to another package the Participant is entitled to refund the Buyer according the cancellation terms and conditions.

12.8. The Participating Partner has the right to also adjust the package for less significant part of the program that benefits the quality execution of the package or that supports a complete package execution. In that case the Buyer only can rejects if the package executions is of a provable and demonstrable negative consequence more than minor meanings to the package execution.

12.9. Full refund is not applicable to Force Majeure, excluded overbooking.

12.10 If on the package date the services agreed to cannot be provided, the Participating Party shall provide alternative equivalent solutions to continue the program in the Package. If the adjustment is not possible or for valid reasons are not accepted by the Buyer, provides the Participating Partner a suitable solution which includes transportation to the place where the package initially had to be adjusted or to another agreed location. The Participating Partner is accountable for any shortcomings in the package execution as offered to the Buyer.

12.11. The Participating Partner must inform any adjustments in the program or times to the Buyer.

13. Force Majeure
13.1. When due to circumstances the Package execution cannot take place because of the Participating Partner, any sub partner or the program of the Performance has to be adapted to the circumstances because of bankruptcy, illness, death The Participating Partner shall provide within the best of his abilities equivalent replacement.

13.2. An Act of God, war strikes, natural disasters or any other attacks in the Country where the Package execution takes place that has a major impact of the Country's logistics both parties will have the right to cancel the Agreement with a 30 days written advanced notice. Both parties shall agree on a for both parties agreeable payment solution of the expenses.

14. Obligations and Liabilities
14.1 The Participating Partner is obliged to execute the Package confirmed and purchase at the time of purchase by the Buyer and answers to the Buyer's standards of reasonable expectations raised with the display of the package.

14.2 The Buyer shall inform EZY-Go within 7 days after the package execution about his/ her experience sending an email to clientcare@ezy-go.com. Any complaint can be addressed to complained@ezy-go.com.

14.3. The Participating Partner is fully responsible for the packages sold through EZY-Go and for the execution of these packages.

14.4. The Participating Partner is fully responsible for any safety and outcome of the package experience. The Participating Partner is obliged to support the Buyer and package participant reasonably to reach customer satisfaction. If support needs to be provided due to lack of information or any reason for which the Buyer is countable and costs occurs, the Participating Partner has the right to charge the Buyer through EZY-Go.

14.5. If the Participating Partner is liable for any damages claimed by the Buyer, the liability shall be limited or disclosed according the relevant international treaties and accepts no liability covered for damages claimed to compensation under a travel and / or cancellation insurance. Any claim shall never exceed the height of compensation by the Participating Liability Insurance. Any claim shall be decided by the Insurance Partners from the Participating Partner.

14.6. EZY-Go or the Participating Partners can never be held liable for the quality of the service, the execution, the Buyers' and Package Participant's program satisfaction.

14.7 Notwithstanding the preceding paragraphs of this article is the responsibility of the Participating Partner for other damages caused by death or injury of passengers limited to not more than three times the price, unless there is intent or gross negligence by the Participating Partner. In that case the liability is due for confirmation by the Liability Insurance Policy of the Participating Partner.

14.8 Disclosures and/or limitations of the liability of the Participating Partner also applies for the employees of the Participating Partner, any affiliates, service offices and employees being part of the booking or package execution.

15. Buyer's obligations
15.1. The Buyer and the Package Participants are obliged for a correct follow up of directions given by the Participating Partner that includes program, time, safety and correct behaviour and shall not be intoxicated, using drugs or alcohol that can risk any of the above.

15.2. The Buyer will confirm the return trip if included with the Participant Partner's Travel Guide.

15.3. The Participating Partner keeps the right to dismiss or refuse The Buyer or Package Participants from the Package if behaviour is not according the guidelines, is a threat for other participants, or is irresponsible for the Participating Partner to continue the Package execution. All the expenses are for the Buyer.

15.4. If the Buyer has not followed the payment obligation as agreed set by the Participating Partner or EZY-Go, The Buyer shall be charged with 1.5% delinquency charges over every full or accumulated delayed month with a minimum of 3,500 Thai Baht before taxes, unless this amount and legal costs are higher than this amount.

16. Complaints
16.1. Any complaints can be sent to complaint@ezy-go.com. Usually complaints will be processed within the next working day. A complaint report shall be sent to the Buyer. After filling in and returning the complaint report, a copy of the complaint report shall be sent to the Participating Partner for review and follow up. The Buyer also informs EZY-Go with lacks, failure or adjustments during the package execution. The Buyer agrees that EZY-Go cannot be held liable for the execution.

16.2 The Buyer will receive an automatic reply that the complaint has been accepted or disapproved with the written reason for disapproval.

16.3. EZY-Go and the Participating Partner shall discuss and confirm a suitable solution for the complaint within 7 days in writing prior to sharing with the Buyer. Reasons will be provided for any delays.

17. Hold Harmless
17.1 The services provided by EZY-Go are based on sales, marketing and distribution of packages. It shall not in any case be interpreted as that EZY-Go is responsible for the execution of the on the website displayed packages. In case of any dispute between the customer and EZY-Go, the parties which is EZY-Go, the participant shall solve the dispute within 7 days with the customer after the complaint receipt date. If the dispute cannot be solved the Court of Bangkok, Thailand shall be the court of Jurisdiction.
